A breach or violation of any of the Terms will result in an immediate termination of your account and right to use our Service without refund.

2. Restrictions on Network Usage

a. VPNs and Tunneling: Clients may set up VPNs or tunneling services on their servers however, they are subject to a monthly data transfer limit of 20TB. Exceeding this limit may result in temporary throttling, additional charges, or suspension of service if deemed high risk. Additionally, clients must ensure that their VPN or tunneling setups do not disturb or interfere with other users' access to the network.

b. Speed Test Servers: The use of our network resources to host speed test servers or similar bandwidth-measurement tools is prohibited. This includes any activities aimed at testing or benchmarking network speed and performance. Clients found hosting such servers may face service limitations or suspension.

c. Cryptocurrency Mining: The use of our network resources for cryptocurrency mining or related activities is prohibited. This includes mining operations, blockchain validation, and related computational tasks that can adversely affect network performance and resource availability.

d. High-Volume Email Services: Hosting of high-volume email services, including bulk email or mailing lists, is prohibited. This restriction is in place to prevent potential abuse and ensure optimal network performance for all users. Clients must adhere to these restrictions to avoid service disruptions.

e. Distributed Denial of Service (DDoS): We provide DDoS protection for our network to safeguard against attacks. Clients are strictly prohibited from using our network resources for conducting or testing DDoS capacity, including any form of outbound attacks targeting other networks or services. Any use of our services for such activities, whether against their own services or others, is not allowed and may result in immediate service termination.

f. Server Automation and Bots: The use of server automation tools or bots that generate excessive network traffic or server load is prohibited. This includes, but is not limited to, automated scripts, scraping tools, and other mechanisms that can strain our resources or disrupt service stability.

Illegal Activities: Any use of our network resources for illegal activities, including but not limited to, unauthorized access to networks, distribution of illegal content, or any form of cybercrime, is strictly prohibited. Such activities will result in immediate termination of service and potential legal action.

h. Proxies and TOR: Hosting proxies of any kind, including but not limited to TOR exit nodes or any other TOR-related services, is strictly prohibited on our network. Any attempt to set up or use these services will result in immediate action, including potential suspension of service. Clients must ensure that their services do not include proxy servers or TOR nodes.
3. Service Limits
Although services may be advertised as "unlimited" or "unmetered," these terms are subject to the physical constraints of our hardware and network infrastructure. Our fair use policy is in place to prevent abuse and to ensure equitable use of resources. Examples of activities that may trigger fair use considerations include, but are not limited to:

Excessive resource consumption, including bandwidth, CPU, or memory, that impacts the performance of other users.

Unusual spikes in activity that exceed typical usage patterns and cause strain on the network or hardware.

Use of services that causes persistent or widespread disruption to our infrastructure or other users.
4. Fair Use Enforcement
Fair use is determined at the discretion of the ABR Hosting administration team. We will assess usage patterns and may take action if we determine that your use of the services is excessive or abusive. Actions we may take include:

Issuing a warning or notification to adjust your usage.

Temporarily disabling or limiting certain features to reduce resource consumption.

Requesting that you upgrade to a higher service tier to better accommodate your usage needs.

Suspending or terminating your services (without any form of refund for paid services) without prior warning in cases of severe or persistent abuse where immediate action is required.
5. Free Trials and Initial Refund Window Abuse
We may offer free trials and initial refund windows to allow users to evaluate our services. However, we reserve the right to refuse service or deny refunds in cases where:

Free trials are used to exploit or abuse our services beyond the intended evaluation purpose.

Initial refund windows are used to avoid payment obligations while using services extensively.

Users engage in behavior that we determine is intended to misuse or exploit the refund process.
6. Monitoring and Enforcement
We actively monitor network traffic to ensure compliance with this Fair Use Policy. Clients found in violation may receive a warning, face temporary throttling of their network speeds, or, in severe cases, account suspension. We prioritize open communication and will endeavor to contact any client found in breach of this policy before taking action.

8. Policy Review
ABR Hosting LTD reserves the right to review and modify this Fair Use Policy periodically to adapt to changing technologies, challenges, and client needs. Clients will be notified of any significant changes.
9. Customer Responsibility for Customer's Users
Each ABR Hosting customer is responsible for the activities of its users and, by accepting service(s) from ABR Hosting, you agree to ensure you and your customers abide by this fair use policy at all times.
